Definitions
➢ “CloudStrike Hosting’’, “we”, “us” or “our” refers to CloudStrike Hosting, The service provider.
➢ “Products” or “Services” refer to the game servers, VPS’s and other products listed on our website. This also includes anything that is acquainted with these products.
➢ “Clients”, ”Customers” , “users”, “you” or “your” refers to any individual that interacts with or accesses our services.
Applicability
1.1. These terms and conditions will apply to all quotations, offers, activities, orders, agreements and deliveries of services or products by or on behalf of CloudStrike Hosting.
1.2. Parties can only deviate from these conditions if they have explicitly agreed upon in writing.
1.3. The parties expressly exclude the applicability of supplementary and/or deviating general terms and conditions of the customer or of third parties.
Account Creation and Usage
2.1. In order to access and use our Services, you must meet the following requirements:
1 You must be at least 18 years old. If you are under 18 years old, you must have the necessary legal capacity to enter into this Agreement on behalf of an entity.
2 By creating an account, you confirm that you meet the age or legal capacity requirements mentioned above. Please note that our Services are intended for users who are at least 18 years old or have the necessary legal capacity.
2.2. When creating an account, it is important to follow these guidelines:
➢ Provide accurate and complete information during the registration process.
➢ Take responsibility for maintaining the confidentiality of your account credentials.
➢ Be aware that you are responsible for all activities that occur under your account. If you decide to delete your account or go inactive, we will retain this data for a short period of time in case you choose to reactivate or for legal matters.
2.3. When using our Services, you are prohibited from:
➢ Violating any applicable laws or regulations.
➢ Infringing upon the intellectual property rights of others.
➢ Engaging in any activity that may disrupt or interfere with the operation of our Services or network.
➢ Transmitting or storing any illegal, harmful, or offensive content.
➢ Using our Services for any illegal or unauthorized purposes.
➢ Attempting to gain unauthorized access to any system, network, or data.
➢ Engaging in any form of harassment, spamming, or sending unsolicited messages.
➢ Misrepresenting your identity or affiliation with any person or entity.
2.4. We retain the right to suspend or terminate your account or access to our Services if we determine, at our sole discretion, that you have violated any provision of this Agreement. There will be no refund possibility.
Prices
3.1. CloudStrike Hosting is entitled to adjust all prices for its products or services, shown in its shop, on its website or otherwise, at any time.
3.2. CloudStrike Hosting has the right to adjust prices quarterly.
3.3. CloudStrike Hosting will communicate price adjustments to the customer prior to the moment the price increase becomes effective.
3.4. The consumer has the right to terminate the contract with CloudStrike Hosting if he does not agree with the price increase.
Payments
4.1. The customer must have paid the full amount within a day after ordering.
4.2. Payment terms are considered fatal payment terms. This means that if the customer has not paid the agreed amount at the latest on the last day of the payment term, their service will be suspended. After a period of 3 days the service will be terminated.
4.3. If a customer is not satisfied with the services supplied by CloudStrike Hosting, they may request a refund which can be done through the billing panel. This can only be done within a 72-hour period after the purchase of the service. Any fees connected to the payment shall be paid by the customer.
4.4. By choosing to be automatically billed through any of the payment gateways, you authorize CloudStrike Hosting to capture and securely store your payment details and capture payments on the date any invoice is due.
4.5. Any overpayments made, manually or automatically, may be refunded if requested 14 days after the payment was made. Any fees connected to the payment shall be paid by the customer.
4.6. Customers are responsible for canceling any automatic payments or subscriptions, these may be refunded within 14 days. Any fees connected to the payment shall be paid by the customer.
Refunds
5.1. If a customer is not satisfied with the services supplied by CloudStrike Hosting, they may request a refund which can be done through the billing panel. This can only be done within a 72-hour period after the purchase of the service. Any fees connected to the payment shall be paid by the customer.
5.2 There are exclusions to our refund policy, things we do not offer refunds for are:
1 Server upgrades
2 Server location transfers
3 configurable options
4 Credit purchases.
If there are refunds due to CloudStrike Hosting’s agreement to fault, any fees connected to the payments made will be accounted for by the customer.
Product and Service Availability
6.1. As a hosting company we shall do our best to keep our servers up and up to date to guarantee optimal uptime. However, we cannot promise that our services will be available or bug free at any given time.
6.2. There shall be chances of downtime for upgrades/downgrades, maintenance, transfers or any other technical services that might cause periodic downtime or server restarts.
6.3. Any maintenance or upgrade/downgrade services shall be notified beforehand.
Server Data and Data backups
7.1. As a customer you are required to safely handle your data, as are we as a hosting company. This means that we shall not access any data unless requested or in any case of a rule/agreement breach.
7.2. As a customer, as well as any other users or third parties connected to the customer, are responsible for your own data, this means that if there are any corruptions or data loss, you solely are responsible for it if caused by you or anyone connected to you.
7.3. If a customer is suspected or found to be guilty of doing anything illegal or in breach of any rules or agreement connected to CloudStrike Hosting, we are fully within our rights to remove any harmful content without notice or if significant enough, cancel the service without any refunds.
7.4. Customers are responsible for making back-ups of their servers and keep these up to date. We as CloudStrike Hosting are not responsible for any data loss but shall of course do our best to prevent such.
Support usage and availability
8.1 Due to ease-of-use CloudStrike Hosting’s discord server has been assigned to be the primary place for support requests, there is also a support option in the client area which is only accessible by management.
8.2 As we at CloudStrike hosting try to aim for best and quickest support, this does not mean that we can be fully available 24/7, we aim to be available to our clients as much as we can but cannot guarantee there will be no wait time due unexpected reasons.
8.3 If there is found to be any harm or toxicity, by any means, to any part of CloudStrike Hosting’s staff team we will give a warning to that customer. If this warning does not stop the customer from their harm or toxicity, we reserve the right to terminate their services without notice or a refund, even if this does fall within the refund period.
Service usage
9.1. The Customer, as well as any other users or third parties connected to the customer, agree not to misuse or overuse any services they have access to. This includes but is not limited to CPU, RAM, Storage or bandwidth. If it concludes that this is of matter, we have the right to cancel the service and temporarily or permanently restrict your account.
Assistance in Data Recovery
10.1. In cases of data loss or corruption, CloudStrike Hosting may, at its discretion, offer assistance in data recovery. However, such assistance is not guaranteed and may be subject to additional charges.
Duration of the agreement
11.1. The obligations of confidentiality shall remain after the termination or expiration of this Agreement and shall remain in effect for a period of 6 months following such termination or expiration.
Privacy
12.1. Both parties agree to take reasonable measures to protect the other party's confidential Information and to only disclose it to their employees or agents who have a need to know and are bound by obligations of confidentiality.
Confidential Information
13.1. Cloud Strike and the User acknowledge that while using our Services, each party may have access to certain confidential and proprietary information ("Confidential Information") of the other party. Confidential Information includes, but is not limited to, trade secrets, technical information, business plans, customer data, and other sensitive or proprietary information.
Exceptions
14.1 The obligations of confidentiality shall not apply to information that: 1. Is or becomes publicly available without breach of this Agreement 2. Is rightfully obtained from a third party without any obligation of confidentiality 3. Is independently developed by the receiving party without reference to the disclosing party's Confidential Information 4. Is required to be disclosed by law, regulation, or court order. In such cases, the party subject to the requirement shall provide prompt notice to the other party to enable them to seek a protective order or other appropriate remedy.
Indemnification
15.1. You agree to indemnify, defend, and hold CloudStrike hosting, its affiliates, officers, directors, employees, and agents harmless from and against any claims, losses, damages, liabilities, and expenses arising out of or in connection with your use of our Services or any violation of this Agreement.
Obligations
16.1. Each party agrees to maintain the confidentiality of the other party's Confidential Information and not to disclose or use such information for any purpose other than as necessary to fulfil their obligations under this Agreement.
General Provisions
17.1. This Agreement constitutes the entire agreement between you and CloudStrike Hosting
concerning the subject matter herein and supersedes all prior or contemporaneous agreements, understandings, or representations.
Settlement
18.1 The customer waives his right to settle any debt to CloudStrike Hosting with any claim on CloudStrike Hosting.
Governing Law and Jurisdiction
19.1. This Agreement shall be governed by and construed in accordance with the laws of The Netherlands. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of The Netherlands.
Waiver
20.1. The failure of CloudStrike Hosting to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision.
Survival
21.1. The obligations of confidentiality shall survive the termination or expiration of this Agreement and shall remain in effect for a period of 6 months following such termination or expiration.
By using our Services, you acknowledge that you have read, understood, and agreed to be bound by this Terms of Service Agreement. If you do not agree with any provisions of this Agreement, you should not use our Services.
